What Paperwork is Needed to Buy a Gun Online?

What Paperwork is Needed to Buy a Gun Online? Buying firearms online is a simple process, however, people who purchase guns online are not exempt from completing the necessary paperwork and procedures that come along with buying firearms from licensed dealers.

In the United States, people who buy firearms from licensed dealers are required to fill out the ATF Form 4473 Firearm Transaction Record. The only situation in which buyers are not required to fill out this form is when the purchase of firearms is private and from unlicensed sellers. However, some states require private gun sales to be completed through FFL dealers and these types of sales require the Form 4473 to be filled out.

What is the ATF Form 4473?

Promulgated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives in the United States Department of Justice, the ATF Form 4473 coincides with the NICS background checks required for all people who attempt to purchase firearms in the United States. The form requires basic information from every buyer, such as: name, address, and date of birth, NICS transaction number, and details pertaining to the firearm(s) being purchased, like make, model, and serial number.

When is the ATF Form 4473 Filled Out?

You could access the Internet right now, find firearms you want to buy, and place orders. But, the guns you buy (if you buy) won’t be shipped directly to your doorstep, because any firearm purchased online must be sent to FFL dealers for pick-up. When you go to the FFL dealer you choose to pick up your firearm, this is where you will fill out the Form 4473.

What Do Dealers Do With the Form 4473?

In addition to using the information from your Form 4473 to complete your background check, the dealer will also record the information from your Form 4473 into a bound-book called an Acquisition and Disposition Log.

Dealers are required to keep this information for at least 20 years and when dealers retire they must surrender theirs logs to the ATF.

For criminal investigations, the ATF is allowed to inspect and require copies of Form 4473s.

Form 3310.4

The sale of 2 or more handguns to 1 person within a 5-day period must be reported to the ATF on a Form 3310.4.

Forms are given the same status as tax returns under the Privacy Act of 1974 and cannot be disclosed by the government to private parties or other government officials (except in accordance with the Privacy Act).

eForm 4473:

The eForm 4473 is designed to eliminate errors in completing the Form 4473 for the firearm purchaser and the licensed seller. This form is provided to the public free of charge via the ATF eForm website.

Know Before You Go

You don’t have to worry about filling out the ATF Form 4473 until you go to your FFL dealer to pick up your firearm(s), but it can’t hurt to know what to expect before you go, like for example: in addition to filling out the Form 4473, dealers require a state-issued photo ID and your social security number.

Be Aware of Local, State, and Federal Gun Laws

Buying firearms online is a simple process, but you can save yourself a lot of hassle and wasted time if you are aware of local, state, and federal gun laws before you buy firearms. Our advice to you is this: before you buy a gun online, find a local FFL dealer near you, and give them a call. Ask them about their firearm transfer policies, find out how much their transfer fee is, and ask them what you need to know about local and state gun laws. You can find this information online, but this way you can have a conversation with a person who knows what he or she is talking about, because he or she works with guns daily.

FFL dealers who sell firearms online are not going to ship a gun or firearm accessories to states where the items are illegal to use. But if you are going to be a gun owner, then you must be aware of local, state, and federal laws pertaining to you.
