These Terms and Conditions shall be governed by the laws of the State of South Carolina. By placing an online order with DEguns, customer hereby:

Submits to the exclusive jurisdiction of the federal or state courts located in Lexington or Richland Counties, South Carolina, in any litigation, suit, action or proceeding arising out of, or relating to, the order or these Terms and Conditions knowingly, voluntarily, and irrevocably consents to the personal jurisdiction and venue of said court waives any right to dismiss or transfer it may have based on improper venue or forum nonconveniens to the conduct of any proceeding in said court.

By placing an order through this website, customer agrees to HOLD HARMLESS AND INDEMNIFY DEguns for any and all costs, damages, or expenses (including reasonable attorney and other professional fees and disbursements) arising from any claim, cause of action, or legal dispute of any kind arising from or relating to the transaction or DEguns's enforcement of these Terms and Conditions.

Severability

If any provision of these Terms and Conditions shall to any extent be held invalid or unenforceable by a court of competent jurisdiction, then: (a) the remainder of the Terms and Conditions shall not be affected, and every remaining provision of the Terms and Conditions shall be valid and binding to the fullest extent permitted by law, and (b) a suitable and equitable provision shall be substituted for such invalid and unenforceable provision in order to carry out, so far as may be valid and enforceable, the intent and purpose of such invalid or unenforceable provision.

ATF FINAL RULE Rule 2021R-05F

In accordance with the ATF's final rule 2021R-05F, DEGun's follows all the regulations and definitions summarized below and explicitly stated throughout the terms and conditions. Deguns does not sell any frame or firearm unserialized.

Under the new ruling:

Definition of "Frame or Receiver"

  • Identifies only one part of a firearm to be the "frame" or "receiver" that requires a serial number. It is the part that provides housing or a structure for one specific, primary fire control component of weapons that expel a projectile; or one specific, primary internal sound reduction component of firearm mufflers or silencers.
  • Definition of a "frame or receiver" includes a partially complete, disassembled, or nonfunctional frame or receiver that has reached a stage in manufacture where it may quickly and easily ("readily") be made to function as a "frame or receiver" and expressly excludes a block of metal, liquid polymers and other raw materials or a frame or receiver that has been destroyed.
  • Grandfathers in existing classifications of frames or receivers (to include split frames or receivers) and allows them to be marked in accordance with the existing requirements.
  • Partially complete, disassembled, or nonfunctional frames or receivers, including parts kits, that ATF did not classify as "frames or receivers" prior to the rule will not be grandfathered in under the final rule and will need to be re-evaluated.
  • Licensed manufacturers or importers are required to abide by the new marking requirements only for new firearm designs.

Other Related Definitions

  • Amends the definition of:
    • "firearm" to clarify when a firearm parts kit is considered a "firearm," and
    • "gunsmith" to clarify the meaning of that term and to explain that gunsmiths may be licensed as dealers (without being a manufacturer) solely to mark firearms for unlicensed persons.
      • Includes those engaged in the business of identifying firearms for nonlicensees, increasing access to professional marking services for privately made firearms (PMFs).
      • FFL dealers (in addition to FFL manufacturers and importers) may adjust or repair and return the firearms, including PMFs, without taking them into inventory, if returned to the person from whom the firearm was received on the same day.
      • Non-FFLs may mark PMFs for a licensee if done under the licensee's direct supervision.
      • FFLs may adopt existing serial numbers, including adopting the unique identification number previously placed on a PMF by a nonlicensee, under certain conditions.
  • Provides definitions for:
    • "complete weapon,"
    • "complete muffler or silencer device,"
    • "privately made firearm (PMF)," and
    • "Readily."

DEGuns is compliant with these requirements

Importer and Manufacturer Marking Requirements and Records

  • For new firearm designs, manufacturers must mark the frame or receiver of such weapon with either the serial number and their name and city and state or their name and the serial number beginning with the abbreviated federal firearms license number. Classifications of frames or receivers that are grandfathered in under the final rule will continue to be allowed to be marked in accordance with its existing requirements.

  • Complete non-National Firearms Act weapons, and frames or receivers of such weapons intended to be distributed separately, must be marked within seven days from completion of the entire manufacturing process for the weapon, device, or part, as the case may be, or prior to disposition, whichever is sooner.

  • Complete National Firearms Act weapons and devices, and machineguns and muffler or silencer parts must be marked no later than close of the next business day following the date the entire manufacturing process has ended for the weapon or device, or prior to disposition, whichever is sooner.

  • The records of manufacture/acquisition and disposition by manufacturers and importers must be consolidated into one book similar to dealers. The rule codifies, in part, ATF Ruling 2016-3, Consolidation of Required Records for Manufacturers and ATF Ruling 2011-1, Importers Consolidated Records, that allow licensed manufacturers and importers to consolidate their records of acquisition and disposition without obtaining a variance.

DEGuns is compliant with these requirements

Privately Made Firearms (PMFs)

  • Federal firearms licensees (FFLs) that choose to take into inventory PMFs are required to mark and record PMFs within 7 days of the firearm being acquired by a licensee, or before disposition, whichever first occurs.
  • If FFLs have PMFs in their inventory, they will have until 60 days after the rule becomes effective to mark them. FFLs would have the option to mark their existing PMFs themselves, contract with another FFL, such as a gunsmith, or directly oversee a non-FFL who can perform such engraving services on PMFs. Alternatively, FFLs may deliver or send PMFs to ATF for disposal, or destroy them in accordance with ATF guidance.
  • There is no requirement in the rule for FFLs to accept a PMF into inventory, and they have the option to ask the PMF maker or owner to have the firearm marked by another licensee before accepting it into inventory or the FFL can bring the PMF to another FFL or unlicensed engraver to mark the PMF with their license information, provided they directly oversee the serialization.

DEGuns is compliant with these requirements

Record Retention

  • FFLs must retain their Firearms Transaction Records, Forms 4473, and acquisition and disposition records until they discontinue their business or licensed activity. The rule also allows for paper records older than 20 years to be stored at a separate warehouse or electronically in accordance with a forthcoming ATF Ruling. The separate warehouse is considered part of the licensed premises and subject to inspection.

Firearm Shipments

We ship only to valid FFL Dealers. Firearms cannot be shipped to a P.O. Box.

The customer is responsible for knowing his/her state laws regarding firearm transfers. Contact your local FFL dealer with any questions regarding the sale or transfer of firearms. Contact your local FFL before ordering a firearm to verify their transfer fee and to ensure they will receive your transfer. The customer assumes all responsibility and cost for returned firearms due to FFL refusal or failure to receive.

If you order a handgun, stockless shotgun, complete AR or AK receiver, or stripped lower receiver, YOU MUST be:

  1. A legal resident of the state in which you are ordering.
  2. 21 years of age or older to complete the transfer through your FFL.

Exceptions: Military personnel stationed in a state other than their legal residence may purchase firearms across state lines. Contact your local FFL receiving the transfer as you may have to provide proof of deployment, residence, etc.

Please follow all directions prompted to you at checkout. This will ensure speedier delivery. Please note that the FFL selection on our website is for customer convenience only and does not necessarily mean that DEGuns has the FFL selected on file. The customer may be asked to provide the FFL information that they wish to use. If a customer wishes to change the FFL they want to use after the order has shipped, they will be additionally charged for the cost of shipping. If a FFL is not available at the time of delivery, the package will not be held at the carrier hub and will be returned to DEGuns. Additional shipping charges will apply to orders that need to be reshipped.

Shipping Restrictions

  1. DEGuns will not ship ANY configurations of DEGun Daggers to the state of New York.
  2. DEGuns will not ship ANY items to the District of Columbia (Washington D.C.).
  3. DEGuns will not ship ANY items to the state of Massachusetts.
  4. DEGuns will not ship ANY items to Puerto Rico.
  5. DEGuns will not ship ANY AR or AK Parts or Firearms (Including Receivers) to residents of Connecticut, Chicago, Illinois, Cook County, Illinois, or Deerfield, Illinois.
  6. DEGuns will not ship any AR or AK parts to Denver, Colorado.
  7. Illinois: All hand guns handgun having a barrel, slide, frame or receiver which is a die casting of zinc alloy or other non-homogeneous metal that melts or deforms at a temperature of less than 800 degrees Fahrenheit are prohibited.
  8. Minnesota: All hand guns handgun having a barrel, slide, frame or receiver which is a die casting of zinc alloy or other non-homogeneous metal that melts or deforms at a temperature of less than 1,000 degrees Fahrenheit, of any material having an ultimate tensile strength of less than 55,000 pounds per square inch, and of any powdered metal having a density of less than 7.5 grams per cubic centimeter are prohibited.
  9. DEGuns will not ship ANY AR or AK Firearms (Including Receivers) to residents of Aurora, Highland Park, Deerfield, or Cook County, Illinois.
  10. DEGuns will not ship any handguns to CA that are not on the DOJ roster. This includes Single Shot Exemption conversions.
  11. No AR parts will be shipped to Connecticut. All such orders will be cancelled and the customer will be charged a 5% fee.
  12. Hawaii: All handguns having a frame or receiver of which is a die casting of zinc alloy which has a melting temperature of less than 800 degrees Fahrenheit are prohibited.

Stripped lower receivers will NOT be shipped to the following states:

  1. Colorado (Boulder, Denver, Vail)
  2. Connecticut
  3. Delaware
  4. Massachusetts
  5. New York

Complete AR and AK receivers will NOT be shipped to the following states:

  1. California
  2. Colorado (Boulder, Denver, Vail)
  3. Connecticut
  4. Delaware
  5. Maryland
  6. New Jersey
  7. New York

Non-Compliant AR & AK models will NOT be shipped to the following states:

  1. California (No "assault weapons" can be shipped.)
  2. Colorado (Boulder, Denver, Vail)
  3. Connecticut
  4. Delaware
  5. Maryland
  6. New Jersey
  7. New York

Please note that DEGuns DOES NOT ship high-capacity magazines with firearms to the states listed above. We WILL NOT replace high capacity magazines with state compliant magazines. We DO NOT offer refunds in place of the magazines.

Shipping Restriction Exceptions

  1. Law enforcement officers must provide both their credentials and a letterhead signed by their department's superior officer stating that the firearm will be used in the execution of the L.E.O.'s duties. DEGuns only recognizes City Police Officers, County Sheriff Deputies, and State Police (including Highway Patrol) as L.E.O.'s.
  2. Some of the states listed above may not have L.E.O. exemptions. Please contact us BEFORE placing your order.
  3. DEGuns does NOT ship directly to L.E.O.'s; the order must go to an FFL. DEGuns does NOT make exceptions for this policy.

P.O. Box Shipments / Restrictions

Firearms cannot be shipped to a P.O. Box.

DEGuns abides by all Federal Regulations regarding hazardous material shipped through United States Postal Service. A hazardous material is any article or substance designated by the U.S. Department of Transportation as being capable of posing an unreasonable risk to health, safety, or property during transportation. This includes, but is not limited to:

  1. Minor Blast/Minor Projection Hazard — Ammunition
  2. Oxidizing Substances — Batteries
  3. Flammable Solids — Black Powder
  4. Flammable and combustible liquid — Cleaners, oil, and aerosol cans

If you wish to order any hazardous material, you must provide a physical address for shipment through UPS.

Magazine Ordering Restrictions

DEGuns abides by all state regulations regarding the sale of high capacity magazines. We DO NOT ship high-capacity magazines with firearms to the states listed below. We WILL NOT replace high capacity magazines with state compliant magazines. We DO NOT offer refunds in place of the magazines.

It is the customer's responsibility for understanding state laws regarding magazine capacities. Customers ordering magazines that are illegal to own in their state will have their orders cancelled and will be charged a 5% restocking fee.

  1. California — No magazines greater than 10 rounds.
  2. Colorado — No magazines greater than 15 rounds, effective July 1st, 2013.
  3. Boulder — No magazines greater than 10 rounds.
  4. Connecticut — 10 Rounds and less with a valid permit.
  5. Delaware- No magazines over 17 rounds.
  6. Hawaii — No magazines greater than 10 rounds.
  7. Illinois (North Chicago) — No magazines greater than 16 rounds.
  8. Aurora, Skokie, Chicago, Evanston — No magazines greater than 15 rounds.
  9. Highland Park, Cook County, Dolton, Homewood, Deerfield — No magazines greater than 10 rounds.
  10. Deerfield — No shotgun magazines over 5 rounds.
  11. Maryland — No magazines greater than 10 rounds October 1st, 2013.
  12. Massachusetts — No sales. DEGuns will not ship ANY items to the state of Massachusetts.
  13. New York — No magazines greater than 10 rounds.
  14. New Jersey — No magazines greater than 10 rounds.
  15. Rhode Island — No magazines greater than 10 rounds.
  16. Vermont — No magazines over 10 rounds will be shipped as of April 13, 2018.
  17. Washington D.C. — No Sales. DEGuns will not ship ANY items to the District of Columbia.
  18. Washington State — No magazines over 10 rounds will be shipped as of July 1, 2022.

DEGuns will not ship high capacity magazines for CA customers to a High Capacity Magazine Dealer. High Capacity Magazine Dealers in CA may place orders with DEGuns directly.

Magazine Restriction Exceptions

  1. Ammunition Ordering Restrictions

DEGuns abides by all state regulations regarding the sale of ammunition.

  1. You agree and accept all policies described in our Terms of Use.
  2. You are at least 21 years of age (for handgun ammunition) or 18 years of age (for rifle ammunition).
  3. By purchasing ammunition, you are not violating any local, state, or federal laws.
  4. You have not been convicted of any felony, a misdemeanor of domestic abuse, and you are not chemically dependent.
  5. You have no legal restraint that would prohibit you from possessing, ordering, owning, or transferring ammunition.
  6. You have never been committed to any mental institution, or been adjudicated as mentally defective. You will not sell ammunition to any minor.

We will not ship ammunition to the following areas:

  1. California — No Sales to the cities of Los Angeles, Oakland, Sacramento, San Francisco, or Avalon.
  2. Connecticut — No sales without a valid permit.
  3. Alaska — No Sales. Ammunition must be shipped to a freight forwarder.
  4. Hawaii — No Sales. Ammunition must be shipped to a freight forwarder.
  5. Illinois — FOID required, ID required, No sales to Cook County and Chicago All other Illinois residents purchasing ammunition within or outside the State of Illinois must provide the seller with a copy of his or her valid Firearm Owner's Identification Card or valid concealed carry license and either his or her Illinois driver's license or Illinois State Identification Card prior to the shipment of the ammunition. The ammunition may be shipped only to an address on either of those 2 documents.
  6. Massachusetts — No sales. DEGuns will not ship ANY items to the state of Massachusetts.
  7. Maryland — No Sales to the City of Annapolis and Montgomery County
  8. New York — No Sales to New York City, or its five Burroughs. For all other NY residents Ammo shipments must go to an FFL dealer or registered seller of Ammunition. Need a file copy of FFL/SOA.
  9. New Jersey — When ordering ammunition commonly used in a handgun/to be used in a handgun, email us a copy of your Firearms ID. We must ship to the address on the FID.
  10. Puerto Rico — No sales. DEGuns will not ship ANY items to the Puerto Rico.
  11. Washington D.C. — No sales. DEGuns will not ship ANY items to the District of Columbia.

We will not ship projectiles to the following areas:

  1. Massachusetts
  2. Alaska
  3. Hawaii
  4. New York City (Bronx, Brooklyn, Manhattan, Queens and Staten Island)
  5. Washington D.C.
  6. Any U.S. Territory
  7. Cook County and Chicago, Illinois
  8. Los Angeles, Oakland, Sacramento, San Franciso and Avalon, California

Residents of Illinois, New Jersey and Connecticut must send in a copy of their FOID/FID/Permit. The customer is responsible to know and follow all federal, state, and local guidelines when purchasing and reloading ammunition.

Residents of Rhode Island, When ordering ammunition, you must be 21 years of age or older and must have a Pistol/Revolver Safety Certificate from the Department of Environmental Management. Please send a copy in along with your state ID for verification.

Other Ordering Restrictions

  1. Alaska - No tannerite sales.
  2. Hawaii - No magazines greater than 10 rounds. No AR or AK pistols.
  3. Maryland - No Tannerite sales.
  4. Massachusetts - No sales.
  5. Minnesota - The following firearms are prohibited in the state of Minnesota: GSG Rimfire pistols, Walther Rimfire Pistols, Cobra, Phoenix Arms, and Heritage Arms.
  6. Vermont - No magazines over 10 rounds will be shipped as of April 13, 2018. No pistol magazines over 15 rounds effective immediately.
  7. Washington D.C - No sales.

If you wish to order any hazardous material, you must provide a physical address for shipment through UPS.

Flamethrower Restrictions.

  1. No shipping to Alaska, Hawaii, California (model currently for sale), Maryland, and the city of Warren, Michigan.

Flamethrower ownership is generally legal in the United States without requiring any sort of background check. This is America, and freedom is something we stand for.

As the product name states, it is simply a long range torch. However, Maryland and California do have restrictions regarding such devices. The city of Warren, Michigan also prohibits possession via local ordinance.

In Maryland, flamethrowers are outright prohibited to possess due to falling under the state's definition of a destructive device (not the federal definition).

In California, non-stationary devices that are designed/intended to emit a burning stream at least 10 feet are prohibited without a license issued by the State Fire Marshal. We've developed a nozzle that reduces the output distance to less than 10 feet to create a compliant version (PF-CA) that will be available soon. Nozzles are replaceable and available in our store for those out-of-state trips or transfer to a new owner.

Check with your local laws. It is your responsibility to understand and adhere to all relevant regulations.

The decision in South Dakota v. Wayfair, Inc., et al, overturned prior Supreme Court precedent in Quill Corp. v. North Dakota, which previously required retailers to have a physical presence in a state beyond merely shipping goods in order to require a retailer to collect and remit sales taxes from those in-state customers. Going forward, DEGuns will be collecting and remitting sales tax in those states which require such. Please refer to the link below for more information.

California Notice

California Magazine Ban Lifted August 14th, 2020

The Ninth Circuit Federal Court of Appeals issued a much-anticipated opinion on August 14 finding the large capacity magazine ban is unconstitutional. DEGuns applauds the court's ruling and is proud to have provided an affidavit in support of the challenge to the illegal ban.

As the court said, "California's near-categorical ban of LCMs infringes on the fundamental right to self-defense…. [I]t substantially burdens the core right of self-defense guaranteed to the people under the Second Amendment. It cannot stand."

"This decision is a victory for the Second Amendment and a reason DEGuns supports the Second Amendment Defense Fund," said DEGuns owner Jamin McCallum. "Protecting our freedoms and defending our constitutional liberties are DEGuns's founding principles."

DEGuns values your freedom and constitutional rights above all else. However, DEGuns will not accept new orders nor will ship any order until the Ninth Circuit Federal Court of Appeals decision becomes finalized. Once this decision is finalized, we will start accepting new orders and ship 10+ round magazines to California Customers.

Due to recent changes in California state law, DEGuns will no longer be able to ship so called "assault weapons" to the state of California. This would include all DEGuns AR-15 complete lowers, AR-15 complete rifles, and all DEGuns AK-47 rifles. This would also include other makes and models of these same firearm platforms manufactured by other companies. Example: Colt AR-15 rifle.

As of the 1st of July 2019, all California ammunition orders must be shipped to one of the following:

  1. California FFL (order will be shipped to the address on the FFL)
  2. CA DOJ Certificate of Eligibility (COE) holder (MUST send COE and Driver's License if the address is NOT printed on the COE).
  3. Someone who holds an Ammunition Vendor's License (MUST send AVL and Driver's License if the address is NOT printed on the AVL)

No ammunition sales to the cities of Los Angeles, Oakland, Sacramento, San Francisco, or Avalon.

Deerfield, Illinois Notice

Deerfield, Illinois has recently passed a ban on large capacity magazines and so called "assault weapons". Every citizen in Deerfield has until June 13, 2018 to remove, destroy, or sell the firearms described in this Ordinance (O-18-06). Due to the nature of the ordinance, DEGuns will no longer ship magazines or firearms after June 1, 2018 if it falls within these categories. This would include AR rifles, completed receivers, or stripped receivers and all AK rifles. This would include other makes and models of these same firearm platform manufactured by other companies. Example: Colt AR-15 rifle. This will also include any AR or AK parts and pieces (i.e. AR rifle kit, build kit, or parts kit) Any magazines over 10 rounds for a pistol or rifle or shotgun magazines cannot be over 5 rounds will not be shipped.
